SCOPE AND DEFINITIONS

These general conditions cover all information relating to the sale, including the registration and purchase of items in the online store www.dfw89.com
By using and/or purchasing from the online store, the Customer binds himself to these Conditions and its other policies, so if he does not agree with them, he should not use it. DFW89 is headquartered at Rua Santa Maria, Viatodos and has fiscal number 509038620.
DFW89 may at any time update, modify or replace these Conditions and/or associated policies.

REGISTRATION

To make a purchase, you must register in the online store, creating your account and providing some personal data. If you are an already registered user, simply identify yourself with your email address and password.

The customer authorizes the use of the data provided for contact purposes whenever necessary, as well as the provision of his personal data (name, address and contact) to the carrier in charge of delivering the items.

Our e-commerce services are available exclusively to end-users (user who buys outside their business or profession).

PURCHASE

When you browse the online store and after you find the product(s) you want to buy, you should add them to your shopping cart.
Once you have chosen all the items you want, finalize your purchase by filling in your personal details and selecting your payment method. Be especially careful when writing the address.
Review your order and proceed to payment by confirming it. When you select the Checkout button at the end of the purchasing process, your order is finished and you will receive an order confirmation email with the details of the products you are buying.

PRICES

The price of the products on sale in DFW89’s online store is in euros, with VAT (23%), taxes or other levies included.
DFW89 reserves the right to change prices without notice. The prices displayed at the time of purchase are the prices applied to that purchase. The site is updated with the utmost attention, however, should there be any error in the prices, DFW89 does not commit to the offer and reserves the right to cancel your order.

PAYMENT

Payment can be made through Ifthenpay, ATM Reference, Credit Card and MBWAY. VAT has been added to all prices, at the applicable legal rate where applicable and assuming that the buyer is the final consumer.

PAYMENT BY ATM REFERENCE

You have 48 hours to make the payment. After this deadline, the reference is no longer valid and the order will not be confirmed.

All products remain the property of DFW89 until the end consumer has paid in full all amounts due under any contract, including payment of costs associated with the delivery of the products. You may not sell, dispose of, or encumber any Product until full ownership of that Product has been transferred to you.

DELIVERIES

We deliver to Portugal mainland and islands, and Europe (Germany, Spain, France, Italy, Netherlands, Luxembourg, Austria, Belgium, except EU islands).
Deliveries are made on the days and times used by the logistics operator.

We do not deliver to collect charges. We do not deliver items to PO boxes. When your order is shipped, you will receive an email / sms with all shipping information.

The shipping costs are free for purchases equal to or greater than 70€ delivered in mainland Portugal.

Delivery delays may occur for any of the following reasons: delays by carriers; sales or promotional periods; difficulties in delivery to the recipient; holidays.

If you are unable to be at the delivery location at the agreed time, please contact the carrier, through their Customer Service line, so they can reschedule the delivery for another day. You may be charged for postage to resend it.

Any additional fees for customs reasons are the sole responsibility of the customer.

DEADLINES

For all the countries described above, delivery is made through the FEMA company during their business hours.

We will only fulfill the delivery of an order (always by hand) if the delivery address is a home or office located in one of the countries mentioned in the list above, within a maximum of 15 days. We do not guarantee this deadline during periods of promotions, sales, Christmas, and when out of stock.

RETURNS

You have 15 days to return the product, free of charge, by filling out theReturns Form. In addition, you must inform DFW89 that you are going to make a return via emaildfw89malhasdf@gmail.com
To make a request to return an order, you must:
For returns from Portugal you can send through CTT by regular mail. For returns from the rest of Europe you must send by registered mail.

GIFT RETURN

It is not possible for a person who has received a product as a gift from another person to return it. In this case, in order to proceed with the return, you should contact the person who bought it, so that they can return it with proof of purchase.

CANCELLATIONS

The customer can cancel the order as long as it has not yet been shipped. To do so, please contact us.
If the products shown are no longer available at the exact time of checkout, we will notify you within 30 days and refund your payment.

REFUSAL TO ORDER

DFW89 reserves the right not to accept the order or to cancel the purchase if it finds that the proper conditions are not in place. Such as:
– The product is no longer available (we will refund your money)
– Billing information is not correct
– The order is flagged by our Security Systems as an incorrect order or an order susceptible to fraud
– The transfer for payment has not been received within 5 days after acceptance of the order
– The customer is under 16 years of age
– The customer is a reseller
– Some kind of error has occurred in the price quotation
– Unable to deliver to the address provided
All orders submitted by the user are subject to acceptance by DFW89.

PRODUCTS

DFW89 markets exclusive, top-quality, copyrighted products and is a registered trademark.
The products may not exactly match the actual clothing in terms of displayed image and colors, mainly due to the internet browser and monitor used.

The articles presented in the online store are accompanied by a description of their characteristics, so it is assumed that the customer has taken note of them before placing an order.

DEFAULTS

Due to the tight quality control in our confections, it is very difficult for one of our products to be damaged or defective. However, in case this happens, and it is a manufacturing defect or a deviation from the specifications presented, the amount associated with that purchase will be refunded and the shipping costs for that return will be assured. Whenever the Customer considers that the purchased article has a production defect, he should contact us.

Excluded from this warranty are materials subject to deterioration, oxidation, loss or loss, defects caused by misuse, improper care and cleaning, negligence, misuse, modifications, unauthorized repairs, accidents, or normal wear and tear, and damage caused by the use of other products either in conjunction with them or separately.

CARE OF THE PARTS

RESPONSIBILITY

DFW89 is not responsible for damages resulting from interference, interruptions, computer viruses, malfunctions or disconnections of the operating system that may temporarily prevent access, navigation or the provision of services to Customers.

DFW89 is not responsible for any misuse of the Customer’s access data to the online store, data considered personal and non-transferable, by third parties.

DFW89 is under no obligation to exchange items that are unavailable. All exchanges are subject to stock availability. In extraordinary situations, an item may be unavailable. Whenever this happens, we will inform the Customer, and if he wishes, we will refund the amount, within a maximum of 15 days.

CONTENT

All content present in the online store is the property of DFW89. Although DFW89 works its platform with utmost care, the information, texts, graphic documents, movies, music and/or other services may contain errors or be incomplete or incorrect. DFW89 shall not be liable for any damages resulting from the use of the website, including damages caused by viruses or any inaccuracy or imperfection of the information, unless such damage is the result of DFW89’s negligence.

PROMOTIONS

Offers in the online store are valid only for the time they are displayed in the online store, unless otherwise communicated in the online store.
